Terms of Service

These Terms of Service (“Terms”) govern your use of the Amaaya app and website (the “Service”), operated by Atlas Commerce (“we”, “us”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract under applicable law to use the Service.

2. Your account

You are responsible for activity that occurs under your account. Sign-in is via Google; keep your Google credentials secure. Notify us at [email protected] if you suspect unauthorised access.

3. The Service

Amaaya provides AI-generated style guidance, outfit suggestions and product recommendations sourced from third-party retailers. The Service is provided for personal, non-commercial use. We may add, modify or remove features at any time.

4. AI-generated content

Style commentary, outfit suggestions, decoded looks and similar content are produced by automated systems and may be inaccurate, incomplete or out of date. Treat them as suggestions, not professional advice. You are responsible for your own choices.

5. Third-party products and links

Product details (price, availability, sizing, descriptions, images) are aggregated from third-party retailers and may be inaccurate, stale or removed without notice. Purchases happen on the retailer’s own site under their terms; we are not party to those transactions and do not warrant the products.

You retain ownership of the photos, text and other content you submit (“User Content”). You grant us a worldwide, royalty-free, non-exclusive licence to host, process and display User Content solely to operate and improve the Service for you. We do not use User Content to train models that are made available outside the Service.

8. Intellectual property

The Service, including its software, branding, look and feel, models and curated content, is owned by Atlas Commerce and protected by applicable law. You receive a limited, revocable, non-exclusive, non-transferable licence to use the Service for personal use only.

9. Termination

You may stop using the Service at any time and delete your account via the data-deletion page. We may suspend or terminate your access if you breach these Terms or use the Service in a way that causes risk or legal exposure to us or other users.

10. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that recommendations will meet your expectations.

11. Limitation of liability

To the maximum extent permitted by law, Atlas Commerce will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or use, arising out of or in connection with the Service. Our aggregate liability for any claim relating to the Service is limited to INR 1,000.

You agree to indemnify and hold Atlas Commerce harmless from any claim, loss or expense arising out of your User Content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

13. Changes to the Terms

We may update these Terms from time to time. Material changes will be reflected in an updated “Last updated” date and, where appropriate, an in-app notice. Continued use of the Service after a change constitutes acceptance of the revised Terms.

14. Governing law and jurisdiction

These Terms are governed by the laws of India. The courts at Bengaluru, India have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
